Wasaga’s latest casino revenue payment over $380K
OLG has paid the town almost $2.4 million in revenue shares since the Playtime Casino opened in November, 2022 The Ontario Lottery and Gaming Corporation (OLG) confirmed the latest payment to the Town of Wasaga Beach as hosts of Playtime Casino totalled $386,031. The payment reflects the town’s revenue share for the second quarter of the year (July through September). To date, the town has received $2,397,782 as the host municipality for the casino, which includes $702,208 since April 2024. Playtime Casino Wasaga Beach opened in November, 2022. Payments to host communities are calculated with a formula used at all gaming sites in Ontario and based on a graduated scale of gaming revenue at the casino. ased casinos serve as a source of good local jobs and generate important economic activity in municipalities that host gaming sites,” said Brian Saunderson, Member of Provincial Parliament for Simcoe-Grey, in a news release. “Proceeds from gaming received through the Municipality Contribution Agreement with OLG, in turn, help strengthen local infrastructure and support critical community programs.” Since 1994, host communities have received more than $2.1 billion in non-tax gaming revenue. Sanborn arrested on fresh charge amid casino sale drama
New Hampshire’s Concord Casino is not a big-time, Las Vegas-style resort and its owner, Andy Sanborn, is not a global kingpin. Yet Sanborn’s legal troubles, including a new fraud charge, and their impact on the casino have made for a fascinating saga. Sanborn, a former state senator, was arrested Wednesday (16 October) on a theft by deception charge. When applying for Covid relief funds in 2020, he reportedly misrepresented the casino’s gross receipts by approximately $1m (£766,665/€920,500). This increased his grant allowance by $188,474, per the New Hampshire Bulletin. If convicted, Sanborn could face a prison sentence of 7.5 to 15 years. This latest charge is separate from a fraud investigation that was launched last August by state attorney general John Formella. In that investigation, Sanborn is accused of misappropriating $844,000 in Covid funds. He reportedly used that money to purchase three sports cars–two Porsches and a Ferrari–the latter of which was a gift to his wife, state representative Laurie Sanborn. He also paid himself back rent for the casino, which is located inside a sports bar. Under state law, casinos were not entitled to relief funds, but Sanborn misrepresented the nature of the business, and apparently, how much it earned. No charges have been filed in the original investigation. But Sanborn has since sued Formella’s office, alleging that investigators wrongfully seized confidential documents in their searches. It is unclear how this latest charge will impact the previous investigation. First fraud scandal led to forced casino sale In response to the first investigation, Sanborn was ordered by the state last December to shutter and sell Concord Casino. The state asked that his gaming licence be revoked altogether, but the case’s original judge, Michael King, declined and instead set a sale deadline of 30 June. There was a stipulation, though, that the deadline could be pushed to 30 September if a deal was imminent. When the new judge, Gregory Albert, assumed the case in June, he granted the September extension. Then on 22 September, Albert granted another psuedo-extension through an ambiguous legal workaround that essentially extended the process by about 50 days. Sanborn’s team has reportedly found a buyer. The state lottery has completed its suitability review of the buyer and sent its findings to Formella’s office. There is no timetable for that review, and if the buyer is not found suitable, the casino’s licence would be suspended for two years. That would render the casino–or what’s left of it–virtually worthless. Albert’s ruling challenged by both sides Since the start of the process, the two sides have gotten increasingly contentious. Both argue the other is intentionally stalling. Albert’s ruling did not help. Both sides have made filings in the last week challenging the decision. Senior assistant attorney general Jessica King argues it was unclear and has led the state to interpret Sanborn’s licence as being revoked. Sanborn’s attorneys, in turn, have requested a rehearing. “…Had the state credibly assured the buyer or (Sanborn) that the (Attorney General’s Office) would finish its (suitability) review by a date certain, (Sanborn) would have welcomed a chance to gracefully end this case,” they wrote, per the Bulletin. “But there is no clarity from the (Attorney General’s Office) and the clock is ticking.” With both sides having challenged, it’s anyone’s guess how much longer Sanborn could have to sell the casino. Another wrinkle is Sanborn’s latest charge. Per state law, any person or business convicted of a felony may not hold a gaming licence for 10 years. Given that the licence is being transferred to another entity, it is unclear if the liability would also transfer. Source link
Golden Could Mull Sale-Leaseback on Unidentified Casino
Posted on: October 18, 2024, 04:21h. Last updated on: October 18, 2024, 04:21h. Golden Entertainment (NASDAQ: GDEN) could consider selling and leasing back one of its casinos as an avenue for raising cash. Golden Entertainment’s Strat Las Vegas. An analyst says the operator could engage in a sale-leaseback on one of its casinos. (Image: OnTheStrip.com) Deutsche Bank analyst Carlo Santarelli put forth that theory in a new report to clients, noting there’s “rising probability” that Golden engages in a sale-leaseback on one of its casinos. The analyst did not speculate as to which gaming venue Golden could consider selling. Currently, the Las Vegas-based gaming company owns all of the real estate on which its eight casino hotels reside. Three of those venues are located in Las Vegas with another trio in Pahrump, Nevada and two more in Laughlin. In terms of property value, The Strat is undoubtedly Golden venue that would fetch the highest price in a sale and likely be the one of most interest to a buyer. That casino resort isn’t officially on the Las Vegas Strip, but it’s close. Santarelli didn’t speculate on a timeline for such a deal materializing nor did he hypothesize as to what company could be Golden’s real estate partner on a sale-leaseback. The operator reports third-quarter earnings on Nov. 7 and it’s possible the rumor is addressed at that time. Selling Casino Could Boost Golden Shares Amid investor concern that persistent inflation and high interest rates are weighing on the lower end of Golden’s casino customer base and its tavern business, the stock has struggled mightily this year, shedding nearly 23% while the Russell 2000 Index is higher by 12.43%. Of late, analysts’ earnings and revenue revisions on Golden have been largely bearish, adding pressure on the stock and potentially fanning the flames of speculation regarding a transaction that could renew the bull case. We believe our updated forecasts account for what we expect to be relatively stable trends in the key segments, adjusted for seasonality, which include a moderation of same-store top-line declines as we move into the fourth quarter,” Santarelli observed. “That said, we acknowledge that the Golden story of late has been one of predominantly negative estimate revisions, which in our view has likely led to more speculation around strategic action.” The analyst lowered his earnings forecast on Golden, but reiterated a “buy” rating on the stock. He added that the depressed valuation on the shares could increase the probability of the operator seeking a transaction that creates value for investors. How Casino Sale Could Affect Golden Without knowing the property Golden would sell, cap rates and tax implications, modeling for the financial impact to the operator is difficult, but Santarelli gave it a go. He said in a sale-leaseback, Golden would absorb $87 million in annual rent costs and have $130 million in cash, including proceeds from the deal, by the end of next year. It can be argued that $87 million in rent assumes either The Strat is the venue Golden will sell or that the operator could engage in sale-leasebacks on multiple properties. Golden could also consider finally making a decision on the Colorado Belle in Laughlin, which has been closed since 2020. Rumors abound regarding the fate of that property, but the operator hasn’t made any public announcements about its plans for it. Source link
Burst pipe dumps sewage on woman at Live! Casino Pittsburgh, lawsuit says
GREENSBURG (KDKA) — A civil lawsuit has been filed against a Pittsburgh-area casino after a Greensburg woman claims a sewage pipe burst, covering her in fecal matter while she was inside the facility. According to the lawsuit, Rita and Robert Romagnoli were at Live! Casino in Westmoreland County on July 28. “While seated at a slot machine, Rita was caused to be drenched with human fecal matter due to an overhead pipe which burst,” the lawsuit says. As a result, Rita was in the hospital for 15 days. “As a direct and proximate result of the negligence of the defendants, plaintiff contracted bacterial pneumonia which resulted in a 15-day inpatient stay at Westmoreland Hospital,” the lawsuit says. The Romagnoli’s attorneys, Summers, McDonnell, Hudock, Guthrie & Raunch, said the family suffered pain, suffering, inconvenience, embarrassment, mental anguish and emotional and psychological trauma. They claim Stadium Casino, a Pennsylvania limited liability corporation that operates Live! Casino, failed to maintain and/or repair the premises to ensure guests were safe, failed to inspect and/or repair known or unknown defects in the premises and failed to prevent and/or remove a dangerous condition of the premises. They’re asking for $30,000 in damages. Since the lawsuit was filed, another woman told KDKA-TV a similar incident happened to her. “I was sitting at a slot machine, and all of a sudden water came pouring down on me and another gentleman that I did not know that was sitting at the slot machine next to me. It was in my hair. It hit my face, and it was all over my clothes. I mean, I was like, literally, soaking wet,” the woman said. The woman didn’t want to be identified or go on camera, but told KDKA-TV that the casino told her at the time it was just water. “I was a little more concerned because I didn’t know what the water was. They assured me that they thought it was just regular water and everything,” the woman said. Now after learning about this lawsuit, the woman wonders what was really dripping on her. She said she’s thankful she didn’t get sick. “It’s a little suspect that the same thing happened to this lady,” the woman said. “It’s very, very scary and very concerning.” KDKA reached out to Live! Casino, which said it cannot comment due to pending litigation. More from CBS News Erika Stanish Erika is an award-winning investigative journalist who joined KDKA in October of 2021. She is thrilled to be back in her hometown and reporting for the station she grew up watching! Source link

Virginia Unions to Rally for Casino in Fairfax County’s Tysons
Posted on: October 18, 2024, 03:29h. Last updated on: October 18, 2024, 03:29h. Several unions in Virginia and the Washington, D.C., metro say they’ll rally next week for a gaming resort in Tysons, a census-designated place in Fairfax County where several of the country’s largest companies are headquartered. Tysons Corner Center, the nation’s eighth-largest shopping mall, in the coming years could become a neighbor to a nearby casino resort. Several unions and trade groups in Virginia’s Fairfax County have lent their support to a casino project. (Image: Tysons Corner Mall) On Tuesday, Oct. 22, at 8:30 a.m., the newly formed Fairfax County Jobs Coalition, a group consisting of several unions and trade groups, including the Northern Virginia AFL-CIO, Unite Here Local 23, Fairfax County Federal of Teachers, Building Trades Unions, and SEIU Local 32BJ, will campaign in support of bringing a casino resort to Northern Virginia. The rally will be held outside the Fairfax County Government Center before the Board of Supervisors meets. This is an important opportunity to bring in more commercial tax revenue for schools and other county services, which is sorely needed,” said David Walrod, president of the Fairfax County Federation of Teachers. During the Virginia Assembly’s 2023 legislative session, state Sen. David Marsden (D-Fairfax) introduced legislation seeking to qualify Fairfax County as a permissible host for a casino. Currently, only four cities in the commonwealth qualify for casinos with slot machines, live dealer table games, and sports betting — Norfolk, Portsmouth, Danville, and Bristol. Petersburg could become the fifth next month. 2023 Casino Effort Shelved Though he faced considerable backlash from Fairfax County residents, area homeowners associations, and the Fairfax County Board of Supervisors, which in January took a formal stance of opposition to a casino, Marsden says the county must diversify its tax base in COVID-19’s aftermath. The county is home to tens of millions of square feet of office space, some of which remains vacant, as work-life adjusted amid the coronavirus. Tysons and McClean are home to numerous companies that employ tens of thousands of workers like Hilton Worldwide, Capital One, Freddie Mac, and Booz Allen Hamilton. Many workers commute from Washington, D.C., to the Virginia suburb via the Washington Metro Silver Line. Marsden and Del. Wren Williams (R-Stuart), who sponsored the Fairfax casino effort in the House of Delegates, filed their bills after partnering with a regional real estate developer that expressed interest in a casino resort undertaking. The gaming bills, which were ultimately yanked after local opposition was raised and county supervisors said they were kept in the dark about the matter, would have limited a casino to a specific address — a former automobile dealership in Tysons along Route 7 that Comstock wants to redevelop into a casino, resort, and convention center. Marsden said it’s his responsibility to “give my county options” to help thwart rising property taxes, taxes he says will only further escalate in the coming years as long-term office leases expire and employers negotiate new terms and/or smaller spaces. Marsden remains committed to the casino discussion and is expected to reintroduce a Tysons casino bill when the Virginia General Assembly convenes for its 2025 session on Wednesday, Jan. 8. Comstock proposed a casino floor spanning 200,000 square feet, which would be capable of housing several thousand slot machines, over 100 live dealer table games, and a sportsbook. The four million square foot resort plan additionally included a hotel, numerous restaurants and bars, convention space, a performing arts center, and affordable housing. Unanimous Opposition Marsden believes Fairfax County could receive $140 million a year in exchange for hosting a casino by way of gaming, property, and other taxes. While Marsden’s casino push has gained the backing of several unions, which do carry political clout in Richmond, a casino in Tysons has been almost unanimously opposed by homeowners and county and municipal governments. I’m not hearing a lot of different things from my constituents. I’m hearing uniformed opposition,” Fairfax Supervisor James Bierman (Dranesville) said in January. The unions hope to win over support by hyping not only the tax benefits but also how the casino resort would create thousands of new union jobs, provide opportunities for small and minority-owned businesses to work with the resort, increase funding for public education, and slow or reduce residential property taxes. Bally’s has a plan to surround Oakland A’s Las Vegas stadium with hotels
For the Oakland A’s, the last month has been eventful. The baseball team played its final game at the Oakland Coliseum, the venue where it has played for the last 56 years. And in Las Vegas the Tropicana Hotel was “imploded” in late September to make way for the A’s new stadium, a sports facility designed by Bjarke Ingels Group (BIG). This week Bally’s submitted a preliminary master plan to Clark County that show plans for resorts and casinos surrounding the A’s new home. Under the Integrated Resort Masterplan “Preview,” three hotel towers are planned for the site. They are shown surrounding the stadium, which is located in the center. Bally’s preliminary and subject-to-change proposal indicates the three hotels would be built over the course of three planned phases. The drawings submitted to the Clark County Department of Comprehensive Planning were drafted by Marnell Architecture, a local firm that is no stranger to casino and hospitality design. “The designs are initial massing diagrams intended to ensure that both our resort program and the A’s stadium program can be successfully accommodated on the site,” a Bally’s spokesperson told the Las Vegas Review-Journal. “We anticipate that the designs will evolve as we advance the project.” The development would involve three phases, each phase would build a hotel tower. (Courtesy Clark County) The first and largest phase seeks to bring a hotel tower with a large casino to the site along Las Vegas Boulevard. It could be joined by a sea of parking, a spa, expansive pool deck, meeting rooms, and a slew of food and beverage outposts both inside the building and in the plazas around it. Under the second phase a second hotel tower would be built next to the first. It is pictured with a smaller, “low-rise” volume extending from the base of its vertical tower; it will also accommodate a large pool deck. In phase three, a hotel tower facing Tropicana Avenue could bring an additional 500 keys to the site as well as more parking spaces. At the northwest corner of the site Bally’s has plans for a video tower it says could measure up to 250 feet. For the Oakland A’s, the move to Las Vegas was a long time coming. The idea was first thrown around in 2006. BIG designed a master plan for a California site with a new stadium at its center. The team announced its decision to decamp for the lights and life of the Las Vegas Strip in November 2023. BIG’s design for a 33,000-seat stadium was likened to the Sydney Opera House and an armadillo by the public this spring when its design was unveiled. Marnell Architecture and Bally’s master plan incorporates BIG’s expressive building in its drawings. Construction will start on the stadium in 2025, and the A’s hope to hit a home run there on opening day in 2028. Source link
Did 17 Drinks Lead to Woman’s Death? Lawsuit Blames Casino
A wrongful-death lawsuit has been filed against Caesar’s Southern Indiana Hotel & Casino and associated parties following the death of Michelle Kelley, who died at the casino resort on March 28, after allegedly being over-served alcohol while visibly intoxicated. But some observers expect challenges for the plaintiff. In the Estate of Michele Kelley and Jason Kelley v. Caesar’s Entertainment Inc., the plaintiff’s attorneys are led by Gregory D. Simms, Camry A. Kelsey and Aaron Murphy of Murphy & Associates in Louisville, Kentucky. The Casino is located in Elizabeth, Indiana. The plaintiff seeks damages for the emotional and financial toll on Kelley’s family. “The death of Michelle Kelley was an absolutely preventable tragedy,” Simms claimed. “Caesar’s served her alcohol to the point of visible intoxication, and kept serving her again and again.” Simms said despite applicable alcohol beverage control laws and statutes, Caesar’s served at least 17 drinks to Kelley while she was “clearly inebriated.” “We will pursue this action vigorously in order to obtain justice for Michelle’s family,” Simms said. According to court documents, Kelley was served at least 17 alcoholic beverages before her death at the casino. The complaint did not indicate the period of time the drinks were consumed. Toxicology reports indicated the Ohio resident’s blood alcohol concentration was nearly three times the legal limit. The suit alleges the defendants, including Caesar’s Entertainment, VICI Properties, and EBCI Holdings, acted with gross negligence by continuing to serve Kelley alcohol despite her obvious intoxication. The complaint also includes unnamed defendants, who appear to possibly be unidentified bartenders and witnesses yet to be named. The lawsuit was filed Wednesday in federal court, but the defendants have yet to respond formally in court. Emails to Caesar’s media relations department went unanswered by press time. Jason Kelley, Michelle Kelley’s husband, is pursuing the lawsuit as the personal representative of her estate and as a father and guardian of their minor daughter. The complaint argues that the casino staff’s actions were not only reckless but indicative of a total disregard for Kelley’s safety. “The death of Michelle Kelley was an absolutely preventable tragedy,” Simms said, accusing Caesar of serving her alcohol to the point of visible intoxication. ‘The Case Can Easily Be Dismissed’ Trial attorney A. Dax Bello of Miami law firm Stewart Tilghman Fox Bianchi & Cain is not involved in the case but specializes in similar legal matters. A. Dax Bello, a partner at Stewart Tilghman Fox Bianchi & Cain. (Courtesy photo) Bello noted the complexities inherent in such lawsuits. “In Indiana, the burden is on the plaintiff to demonstrate that the establishment knowingly served alcohol to someone who was visibly intoxicated,” Bello said. “These cases can be incredibly complex, and the evidence presented will be critical,” Bello said. Bello said the plaintiff attorney must delve carefully and thoroughly into Indiana law. “In Indiana, as in Florida, the legislature has passed a law that affords an immunity to individuals who serve or otherwise provide alcoholic beverages to the public,” Bello said. “In other words, a lawsuit cannot be brought for damages which may arise out of the general service of alcohol. However, the Indiana law provides a very narrow exception to that immunity. That exception comes into play if, and only if, alcohol was served to an individual who was “visibly intoxicated at the time the alcoholic beverage was furnished, and that intoxication was the proximate cause of that individual’s injury or death.” “Lawyers who pursue dram shop/liquor liability cases should have extensive experience in those types of cases,” Bello said. “If they do not carefully navigate the litigation, the case can easily be dismissed by the Court before a jury trial can be had.” The Kelleys are seeking compensatory damages for medical expenses and funeral costs as well as punitive damages, arguing that the defendant’s conduct warrants a penalty beyond mere compensation to deter similar behavior in the future. “This lawsuit is not just about seeking damages; it’s about ensuring that no other family has to endure this pain …,” he said. “We hope to bring about change in how establishments manage alcohol service to prevent tragedies like this in the future.” Source link
